ED files chargesheet against Rahul Gandhi, Sonia Gandhi in National Herald case

New Delhi: The Enforcement Directorate (ED) has filed a prosecution grievance (chargesheet) in opposition to top Congress leaders Rahul Gandhi and Sonia Gandhi in reference to the National Herald money laundering case.

The acknowledged chargesheet also names Congress leader Sam Pitroda, Suman Dubey and others including various corporations.

The subject has been listed for arguments on cognisance in the Delhi Rouse Avenue Courtroom on April 25.

The prosecution grievance has been filed below Sections 44 and Forty five of the Prevention of Money Laundering Act (PMLA), 2002, for the offence of money laundering, as defined below Portion 3, read with Portion 70, and punishable below Portion 4 of the PMLA, 2002.

Special Decide Vishal Gogne acknowledged that as per the submission of the counsel representing the ED, the predicate offence–recorded below grievance case No. 18/2019–involves prices below Sections 403, 406, and 420, read with Portion 120(B) of the Indian Penal Code (IPC), 1860, and is for the time being below trial on the Rouse Avenue Courts in New Delhi.

The court observed that below Portion 44(1)(c) of the PMLA, the predicate offence desires to be tried in the equivalent court that has taken cognisance of the money laundering offence below Portion 3 of the PMLA. The court further illustrious that every and every offences–the predicate offence and the PMLA offence–desires to be adjudicated in the equivalent jurisdiction.

The National Herald case is being heard in a Delhi court. The grievance used to be filed by BJP leader Subramanian Swamy in opposition to Sonia Gandhi, Rahul Gandhi, their associated corporations, and other individuals.
