Huge relief to Mamata government as SC denies CBI probe into creation of supernumerary posts by Trinamool cabinet

In a huge reduction to Mamata Banerjee authorities, the Supreme Courtroom on Tuesday establish aside the part of the Calcutta Excessive Courtroom judgement ordering a CBI probe into the West Bengal cupboard’s decision to make supernumerary posts in assert-speed and aided colleges.

A bench comprising Chief Justice Sanjiv Khanna and Justice Sanjay Kumar, however, made it obvious the probe into other aspects connected to the appointment of 25,753 lecturers and staffers in West Bengal’s assert-speed and aided college would proceed.

A “supernumerary put up” refers to a temporary assert created to accommodate an employee who is entitled to a common put up that's currently unavailable.

The apex court on April 3 invalidated the appointment of 25,753 lecturers and staffers, terming the total selection job “vitiated and inappropriate”.

While turning within the verdict, the bench had made it obvious this could independently tackle the plea raised by the West Bengal authorities “on the realm of the route of investigation by the CBI on the decision taken to make supernumerary posts”.

On Tuesday, the bench took up this stutter component of the plea raised by the assert authorities and acknowledged, “Having regard to aforesaid discussion, we're of the search that the excessive court used to be no longer justified in referring the deliver of introduction of supernumerary put up posts to the CBI pursuant to the cupboard decision.”

The bench referred to constitutional schemes on cupboard choices and acknowledged they will no longer be puzzled in a court of law.

“We account for that our observations in this expose are little to the extent of path to envision the introduction of supernumerary posts and no longer in anyway replicate upon the investigation and chargesheets filed by CBI in other aspects,” the CJI acknowledged.
