Rajasthan HC’s BIG decision, allows live-in couples to live without legal marriage age, says, ‘right to life…’

Rajasthan High Court Verdict: The Rajasthan High Court has given its verdict on the live-in relationship between two adults who have not attained the legal age of marriage. The court’s decision came after an 18-year-old woman and a 19-year-old man filed a petition for security. The two adults, in their plea, mentioned that the woman’s family is opposing their relationship and has even given death threats. The couple stated that they had been living together on their own wish and entered into a live-in agreement on October 27, 2025.

What was the plea of the adults?

The 18-year-old woman and 19-year-old man from Kota have been in a live-in relationship out of their free will. They also mentioned entering into a live-in agreement on October 27 this year. The adults mentioned that the girl’s family has threatened the two of killing them after having a problem with their relationship. They had filed a petition for their security in the court.

What did the public prosecutor say?

After hearing the plea of adults, the public lawyer Vivek Chaudhary mentioned that the man had not attained the legal age of marriage, which is 21. Citing this reason, he argued that they shouldn’t be allowed to live as a live-in couple.

Justice Anoop Kumar Dhand rejected the argument of prosecutor Vivek Chaudhary. He mentioned that the adults’ right to life and personal liberty under Article 21 cannot be denied, even if they’ve not attained the legal age of marriage. The High Court gave its judgement and highlighted that the law of India(BHARAT) does not restrict live-in relationships.

The Court also stated that it’s the duty of the state to protect the life and liberty of its individuals. Justice Anoop Dhand also instructed the police of Bhilwara and Jodhpur to conduct proper verification so that the adults could be given security if required.
